Terms and Conditions

These Terms and Conditions govern your access to and use of Everycall, including the public website, live demo, signup flow, paid service, SMS alerts, and related customer tools.

1. Acceptance of These Terms

These Terms and Conditions are a binding agreement between you and Everycall, a product of Creative Dynamic. By using the website, connecting to the live demo, starting a trial, creating an account, or using the Everycall service, you agree to these terms.

If you are using Everycall on behalf of a business or organization, you represent that you have authority to bind that organization to these terms.

2. Eligibility, Accounts, and Access

You must provide accurate information when creating an account, starting a trial, inviting team users, or configuring your AI receptionist. You are responsible for keeping account credentials secure and for activity that occurs under your account.

You are also responsible for controlling which team members, contractors, or other users receive access to call summaries, lead alerts, transcripts, or account administration tools.

3. Service Description

Everycall provides AI-assisted inbound call handling, browser-based demos, website and knowledge-source ingestion, lead qualification, summaries, SMS or email notifications, and related customer account tools. Features may evolve over time, and some features depend on third-party providers or customer configuration choices.

We may update, improve, replace, or discontinue features at any time. We will generally try to avoid changes that materially break the service without notice, but we do not guarantee any particular roadmap, release schedule, or uninterrupted availability.

4. Free Trials, Pricing, and Billing

If a free trial is offered, it is offered subject to the terms shown at signup. Paid subscriptions are billed through Stripe according to the plan and billing interval you select in checkout or in your account.

Pricing shown on the marketing site is informational and may include promotional presentation, such as annualized discounts. Your actual billing terms are controlled by the active pricing configuration, checkout flow, and account records then in effect.

Everycall currently offers call-based plans for service businesses. Under the current pricing model, calls shorter than 60 seconds generally do not count toward variable call charges, while qualifying longer calls may count toward included usage or overage billing. The usage records and billing logic applied to your live account control for invoicing purposes.

You are responsible for applicable taxes, charge disputes, and keeping billing information current. Failure to pay may result in suspension or termination of service access.

5. SMS Messaging Terms

If you provide a mobile number and opt in, Everycall may send account-related, customer-care, opt-in confirmation, and new-lead alert text messages. Message frequency may vary. Message and data rates may apply.

You may reply STOP to opt out at any time or HELP for help. Consent to receive text messages is not a condition of purchase.

You are responsible for providing only numbers you are authorized to enroll, and for maintaining any notices or consents your own business must obtain before sending messages or notifications to your team members, customers, or leads.

6. Customer Responsibilities and Acceptable Use

You agree that you will:

  • provide accurate business information and keep it reasonably current;
  • submit only websites, documents, scripts, and other materials you own or are authorized to use;
  • use Everycall only for lawful business purposes and not for fraud, harassment, spam, or deceptive activity;
  • provide any caller notices or obtain any consents required by law for call recording, texting, or AI-assisted communications in the places where you operate;
  • review your receptionist setup, lead-routing rules, and business knowledge before relying on the system in production; and
  • avoid using the service for emergency, life-safety, or 911 scenarios.

7. AI, Telephony, and Availability Limitations

Everycall uses AI models, telephony infrastructure, website scanning, and other automated systems. Those systems can make mistakes, generate imperfect outputs, misunderstand a caller, fail to extract the right detail, or experience downtime or delays.

You should treat Everycall as an operational tool that requires configuration, oversight, and reasonable business review. We do not guarantee that every call will be handled perfectly, that every lead will be captured, or that the service will be uninterrupted or error-free.

8. Intellectual Property, Customer Content, and Feedback

Everycall and its related software, branding, site content, and service materials are owned by us or our licensors and are protected by intellectual-property laws.

You retain rights in the business content, websites, documents, scripts, and other materials you submit to the service. You grant us a non-exclusive right to host, copy, access, process, transmit, and use that content as needed to provide, support, secure, and improve the service for you.

If you send feedback, suggestions, or product ideas, we may use them without restriction or compensation to you.

9. Third-Party Services and Integrations

Everycall relies on third-party services such as Telnyx for telephony and messaging, OpenAI for AI processing, Stripe for billing, and email providers for account communications. Customer-enabled integrations or webhooks may also send data to outside systems you choose.

Those third-party services are outside our direct control and may have their own terms, privacy policies, or operational limits. We are not responsible for a third party's independent acts or omissions.

11. Changes to These Terms

We may update these Terms and Conditions from time to time. If we make material changes, we may update this page, update the effective date above, or provide additional notice where appropriate. Continued use of the service after updated terms become effective means you accept the updated terms.
